Information about Legalisation of the Certificate of Legal Capacity to Marry

The Certificate of Legal Capacity to Marry is required if you plan to get married abroad. It confirms that you are legally eligible to marry and that no legal obstacles exist. The document also states your marital status (single, divorced, or widowed).

This certificate is issued by your local registry office based on your permanent residence. It is usually not issued on the spot, so we recommend applying in advance.

In addition to the Certificate of Legal Capacity to Marry, you will generally need your birth certificate and, if applicable, a divorce decree with a finality stamp.

The certificate is valid for six months from the date of issue, but some countries (such as Tunisia) require a document issued less than six months before the marriage date.

For Apostille or Superlegalisation / Embassy Attestation, the document must first be verified by the regional authority or city hall where it was issued. If it was issued outside Prague or Central Bohemia, processing may take up to 14 additional days because the document must be sent to the relevant office for higher verification.

The certificate is multilingual (Czech, English, German, Russian), but since official stamps and parts of the form are only in Czech, you will still likely need a certified translation into the language of the destination country. For Superlegalisation / Embassy Attestation, certified translation into English or the destination language is mandatory, and some countries require the translation itself to be superlegalised.

Is translation required for the Certificate of Legal Capacity to Marry?

Apostille: Translation is not mandatory, but a certified translation into the official language of the destination country may be required for submission abroad.
Superlegalisation / Embassy Attestation: Certified translation into English or the destination language is always required, as embassies do not legalise documents in Czech only.

Is Apostille required within the EU?

Under EU Regulation 2016/1191, Apostille is not required for certain public documents within the EU. However, many authorities still request it, so we recommend checking with the receiving office.

Do you need a power of attorney to arrange Apostille or Superlegalisation?

For Apostille – no power of attorney is needed. For Superlegalisation / Embassy Attestation – some embassies (e.g. Thailand) require a power of attorney; we will provide you with a template for signature verification.
